TERMS AND CONDITIONS
Zamorek Ltd t/a ‘Tutor for Success by Zoë Barrows’ - hereinafter known as ‘TFS’.
Tuition Services:
Providing 11+ Mock Tests as defined on the TFS website ‘11+ Mock Tests for the Buckinghamshire exam’.
These terms and conditions apply in respect of the provision of the 11+ Mock Tests by TFS only.
The TFS 11+ Tuition Course is subject to separate terms and conditions.
11+ Mock Test Day Changes:
TFS reserves the right to make any changes to venue location, Mock Test dates and/or times at any time either prior to or on the Mock Test date.
In this circumstance, parents/guardians will be entitled to a refund for that Mock Test session, or to accept a place on the new date/time at the new venue location.
TFS may suspend or cancel one/all Mock Tests at any time as a result of unforeseen circumstances.
In this circumstance, parents/guardians will be entitled to a refund of the Mock Test/s not fulfilled.
Student Arrival / Collection:
All parents/guardians must arrange to bring/collect their child to/from St Thomas’ Church Hall, Mayflower Way, Holtspur Bucks, HP9 1UF.
Parents/guardians must stay with their child until the Mock Tests administrator has signed them in and indicated that the parent may leave.
Children must not be left unattended at any time outside St Thomas’ Church Hall. The car park is for use by the general public and TFS shall have no liability for children left in the car park unattended.
Parents/guardians must bring their child to the venue (St Thomas’ Church Hall) 15 minutes before the 11+ Mock Test start time.
If your child is late, they will not be allowed into the 11+ Mock Test session and no refund will be issued.
If there is an emergency and an unspecified adult needs to collect your child, please let TFS know beforehand or leave a message/text on TFS’ mobile (as shown on the website home page). TFS will not allow any child to leave without an adult whose name has been notified to TFS beforehand.
TFS shall have no responsibility for children before they enter St Thomas’ Church Hall or after they leave it. Parents/Guardians (or their representatives) are responsible for all children in their care outside St Thomas’ Church Hall.
TFS reserves the right to cease your child’s participation in the 11+ Mock Tests at any time, with immediate effect, at TFS’ sole discretion, should your child disrupt the Mock Test sessions. In these circumstances, no fees will be refunded.
Medical conditions and allergies:
Parents/guardians have a continual duty to notify TFS during the Mock Tests online registration process if their child suffers from any pertinent medical conditions or allergies so that TFS can properly accommodate this need. Parents/guardians are responsible for informing TFS of any changes to their child’s circumstances between booking the Mock Tests and the day of the Mock Test.
If TFS is notified that a student attending an 11+ Mock Test session has an allergy (or other similar condition) the Mock Test administrator will take reasonable precautions to protect this student from exposure to the cause of the allergy, but TFS cannot guarantee non-exposure and takes no liability for inadvertent exposure.
Confidentiality of Materials:
All 11+ Mock Test papers are the property of TFS.
All 11+ Mock Test papers are kept strictly for the use of TFS and will not be issued to parents.
11+ Mock Test Results data table:
TFS uses feedback from the 11+ Mock Tests to rank all participating students according to their results.
This is an important part of the 11+ Mock Tests feedback, and as such parents/guardians agree that TFS can include their child’s exam results in a table or database for the purposes of ranking or results comparison.
These results will be made available to other parents in an anonymised form.
Fees:
All fees paid for the 11+ Mock Tests are non-refundable, except in the circumstances outlined elsewhere in these T&Cs.
Restriction of Liability:
Whilst it is anticipated that students will improve their skills, TFS does not guarantee that its 11+ Mock Tests will enable any student to pass any exams or achieve entrance to any schools. In any event, TFS accepts no liability.
Data protection:
Any personal information collected by TFS, including, but not limited to, information collected on the ‘11+ Mock Tests for the Buckinghamshire exam’ webpage and checkout, may be stored and processed by TFS in hard copy and/or on a computer system.
TFS uses your personal data in order to identify you and your child, provide the 11+ Mock Tests service and fulfil TFS' legal obligations.
TFS does not share this personal data with any third parties except for Stripe Payments Europe Ltd, which processes TFS' payments.
Assignment:
You may not sell, transfer or assign your rights or obligations under these Terms and Conditions without the written consent of TFS.
Entire Agreement:
No addition to, removal or modification of any provision of these Terms and Conditions shall be binding on the parties unless written and signed by TFS.
These Terms and Conditions (as amended from time to time in accordance with the ‘Entire Agreement’) together with any document expressly referred to in any of its terms and conditions, contains the entire agreement between TFS and you relating to the subject matter covered. These T&Cs supersede any previous agreements, arrangements, undertakings or proposals, written or verbal, between TFS and you in relation to such matters. No verbal explanation or verbal information given by any party shall alter the interpretation of this contract.
Law and Jurisdiction:
These Terms and Conditions shall be governed by and construed in accordance with English law and TFS and you hereby submit to the exclusive jurisdiction of the English courts in respect of any dispute or matter arising out of or connected with these Terms and Conditions.
